VIXI SUITE TERMS AND CONDITIONS (for Users)

Welcome to Vixi Suite! This Platform is provided by The Famous Group as a service provider acting on behalf of our client who operates the event or campaign. For purposes of these Terms, The Famous Group and the Client are collectively referred to as “we,” “us,” or “our.” These Terms and Conditions ("Terms") govern your use of Vixi Suite (the "Platform"). By accessing and using the platform, you acknowledge that TFG provides the Platform and technology services only. The Client determines how your content and personal data are used in connection with the event or campaign. You may be subject to both these Terms and any additional terms or notices provided by the Client. In the event of a conflict between these Terms and the Client’s terms, the Client’s terms will apply, except where doing so would reduce protections afforded to the user under these Terms.
1. ACCEPTANCE OF TERMS
By accessing and using the Platform, you confirm that you:
1. Meet the minimum age requirement in your jurisdiction;
2. Have read, understood, and agreed to these Terms; and
3. Consent to the collection, processing, and temporary storage of your data as described in our Privacy Policy.
If you do not agree to these Terms, you must discontinue use of the Platform.
2. DATA PROCESSING AND PRIVACY
We respect your privacy. By using the Platform, you consent to the collection and processing of your data in accordance with applicable data protection laws. For purposes of applicable data protection laws, the Client acts as the data controller and The Famous Group acts as the data processor providing services on the Client’s behalf. You have the right to withdraw your consent at any time by contacting us at ba@thefamousgroup.com or following the opt-out procedures outlined in our Privacy Policy.
- Data Protection: Your personal data will not be sold or shared with third parties for commercial purposes. Additionally, any statistics or analytics provided to our clients regarding Platform usage will be anonymized and aggregated, ensuring that no personally identifiable information is shared.
- Data Storage and Retention: User-generated content and associated metadata will be stored only for the duration necessary for the intended purpose. Retention periods are outlined in our Privacy Policy.
- Security Measures: We implement appropriate security measures to protect personal data from unauthorized access, loss, misuse, or alteration. However, no system is completely secure, and we cannot guarantee absolute security.
3. CONTENT RIGHTS AND USAGE
3.1 License for Uploaded Content
By submitting content through the Platform, you grant The Famous Group and the Client a non-exclusive, worldwide, royalty-free license to host, process, reproduce, adapt, display, and otherwise use such content solely for entertainment purposes during the event, both inside and outside the venue, as well as at third-party locations.
- We do not guarantee that all uploaded content will be displayed.
All rights, title, and interest in any finished or derivative materials generated through the Platform will belong to the Client. The Famous Group retains ownership of all proprietary technology used to facilitate the Platform and generate finished materials. The Famous Group and the Client do not claim ownership of your original uploaded image.
3.2 Compliance with Laws
By using the Platform, you agree that any content you submit:
- Does not infringe on third-party intellectual property rights.
- Does not contain unlawful, offensive, or harmful material.
- Complies with all applicable laws regarding data protection and user consent.
4. THIRD-PARTY INTEGRATIONS
The Platform may integrate with third-party services (e.g., social media platforms, analytics providers). By using these integrations, you acknowledge that:
- Third-party terms and privacy policies apply.
- TFG does not control these services and is not responsible for their privacy, security, or data-handling practices.
5. COMPENSATION AND INDEMNIFICATION
- No Compensation: You acknowledge that you will not receive any compensation for the use of your uploaded content.
- Indemnification: You agree to indemnify and hold harmless The Famous Group, the Client, and their respective affiliates, subsidiaries, parent companies, officers, directors, employees, and agents from and against any claims, damages, or liabilities arising out of or related to your uploaded content or your use of the Platform.
6. MODIFICATIONS AND TERMINATION
- We reserve the right to modify, suspend, or terminate the Platform’s functionality at any time without prior notice.
- We may update these Terms periodically. Any changes will be posted with a revised "Last Updated" date. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
